Dion Mealy,

As the Postal Service contact for the attached notification, I am requesting a meeting, to include the Postal Service appropriate subject matter experts, as soon as possible.

In accordance with Article 34, the Postal Service has taken the position there are no clerk work or time standards.

It is also the Postal Service’s position that these Variance programs are only models/tools to assist the Postal Service in establishing their so-called ‘earned’ hours staffing, which is NOT in the USPS/APWU Collective Bargaining Agreement (CBA) or any negotiated Step Four Agreement.

In accordance with Article 37.3.A.1 all available hours must be used to create desirable duty assignments. Notice there is no mentioning of the words ‘earned hours’ in the CBA.

Any observation/evaluation where the employees are not performing ALL of the required duties would be a flawed observation.

A review of the appropriate standard position descriptions should be shared with the employees to ensure all the mail separation. and cross-dock duties are being performed during the observation. The parties recognize these are not all of the duties that may be associated with the standard position descriptions.

Questions

What is the current funding methodology of mail separation and cross-dock transfers in Sectional Center Facilities and Hub operations and please provide all supporting documentation?

Is this a part of the Postal Service 10-year plan?

Is this a subject of an OIG audit?

What are the anticipated goals?

Will this observation/evaluation directly relate to clerk wages, hours, or working conditions?

Could this observation result in changes to craft jurisdictions?

Which clerk positions are being reviewed?

What handbook and manual is being utilized?

What management instruction is being utilized?

What Standard Operating Procedure is being utilized?

Has all non-supervisory or non-managerial mail separation cross-dock work been returned to the clerk craft?

Are EAS supervisors related to this notification being observed?

Will this observation./evaluation result in the subcontracting out of any bargaining unit work?

The notification states it will be a two-day period over the next two months.

I am requesting an opportunity to be in attendance during the observations for the two sites listed below, as the findings could directly relate to wages, hours, and/or working conditions affecting APWU represented bargaining unit employees.

Can you please share the respective observation days at your earliest convenience in an effort to give me an opportunity to adjust my schedule.

During these same site visits, I am respectfully requesting a representative from Labor Relations be present so that we can concurrently review supervisory positions in the facilities to ensure that all non-supervisory and/or non-managerial duties have been reassigned to the Craft, in accordance with the ongoing four MOUs related to returning work back to the Craft, I want to make sure ALL work is being captured.
