OWCP representation for NALC members

March 2022
“One of the benefits of NALC membership is access to a highly experienced specialist who can advise injured workers on their claims at no expense to the member.

While injured workers are not required to have a representative to file or process their claim, they do have the option to request a representative at any time in the life of their claim.

NALC employs nine regional workers’ compensation assistants (RWCAs) who provide expert advice and representation in the OWCP claims process. RWCAs have extensive training in the FECA claims process and with the sixth edition of AMA Guides to the Evaluation of Permanent Impairment that is used in calculating schedule awards.”

    Michael:

First – My suggestion is to ALWAYS send CERTIFIED MAIL to your claims examiner or manager as a follow up to phone calls or emails, either answered or unanswered. And of course, send questions via the ECOMP system. Notate in your ECOMP and CERTIFIED MAIL the difficulties you are having with contacting your Claims Examiner. All of this will be extremely important if OWCP or USPS deny you any benefits due you because of untimely (late) filings.

Second – Why have you not directly engaged with NALC per the article I posted above? Did you give them an opportunity to directly respond to you? Have you contacted any of the Regional Workers’ Compensation Assistants provided by the NALC?

Hi I have 46 years plus with my military time in the postal service and am presently under CSRS retirement system. I have been on workers compensation (OWCP) since 26 August 2019. My Dr Harrison did surgery on my right rotator cuff but says in time I will need a reverse procedure, OWCP file # 062425019. I have another OWCP claims, file # 062440340, bi lateral car[pal /cubital tunnel syndrome rt/left and a case on my right knee file # 062443281.

I am currently getting paid 75% of my wages as of 26 August 2019 and my wages are from OWCP. I am going on 3.5 years OWCP. I presently have 46 plus years with the postal service. I could retire but I don’t believe I can because I have to accept a job they give me that meets my restrictions. I need help in deciding what to do because my examiner/agent that has my cases for workers compensation hasn’t got back with me after my second call to her. Should I retire and have surgeries on my own under my NALC insurance and my Medicare Part B which I will qualify for after I retire. Can I apply for scheduled awards and how do I do this. Please get back to me when u can and possible answer my questions.

There was discussion prior to the start of the pandemic of the APWU doing this. Never materialized, possibly due to the pandemic. With so many members nation-wide submitting OWCP claims due to Covid, we may have missed the boat on something that our members really needed.

Perhaps we should have filled the Human Resources Director position when Sue Carney retired, instead of bringing in an army of assistants to….. every department at APWU headquarters.

PLEASE, someone put forth a Resolution at National Convention to compel APWU HQ to do similar!
