NLRB Decision – Nasty Postmaster Fired a CCA for Filing Grievances

A nasty postmaster in Katy, Texas fired a CCA for filing grievances. This type of boss exists in too many post offices! This story had a happy ending. The NLRB went to bat for her.

REMEDY

Having found that the U.S.P.S. committed unfair labor practices, it is ordered to cease and desist and to take certain affirmative action designed to effectuate the Act’s policies. It must make Casnel whole for any losses of earnings and other benefits. Her make whole remedy shall be computed in accordance with F. W. Woolworth Co., 90 NLRB 289 (1950), with interest 15 at the rate prescribed in New Horizons, 283 NLRB 1173 (1987), that is compounded daily as set forth in Kentucky River Medical Center, 356 NLRB 6 (2010). Under King Soopers, Inc., 364 NLRB No. 93 (2016), it shall also compensate her for search-for work and interim employment expenses, regardless of whether those expenses exceed her interim earnings. It shall also, in accordance with Don Chavas, LLC d/b/a Tortillas Don Chavas, 361 NLRB 101 (2014), compensate Casnel for the adverse tax consequences, if any, of receiving a lump sum backpay award, and, in accordance with AdvoServ of New Jersey, Inc., 363 NLRB No. 143 (2016), within 21 days of the date the amount of backpay is fixed either by agreement or Board order, file with the Regional Director for Region 16 a report allocating backpay to the appropriate calendar year. The Regional Director will then assume responsibility for transmission of the report to the Social Security Administration. It shall remove from its files any references to her unlawful firing, and notify her in writing that this has been done and it will not be used against her in any way. It also shall post the attached notice under J. Picini Flooring, 356 NLRB 11 (2010).

    My name is Derek Gooden and I am a letter carrier at the Murfreesboro, TN Memorial Blvd office. I have been entangled in an EEOC case resulting from harassment, intimidation and actual threats of violence against me in the workplace. This includes threats by my postmaster.
