A Trenton Metro APWU member / Electronic Technician sent me this job posting today. He asked me to investigate and try to find out if it was contractually valid or a violation. If anyone has any thoughts, opinions or advice it would be much appreciated.
Of specific interest and concern is this part under “Special Requirements” –
“If Job# 95282444 (ET Tour 2 TF) is vacated as part of this fill it will be reverted and bidding will stop. This action is necessary due to complement restrictions.”

I got this response from a Local APWU Maintenance Craft officer:
“If a staffing package shows a need to revert a duty assignment (38.4.A.3), 38.5.C.8 requires the duty assignment identified for reversion to be listed on the NOI. Once that duty assignment is vacated through the in-craft bidding process, it would be reverted and the process would stop. (Also, question #4 in General section of Article 38 (JCIM) touches on this issue.)
That being said, and w/o knowing what the staffing package calls for, its impossible to tell whether or not its proper…”
