On February 6, 2026 a jury of 12 Harris County citizens, after a four day trial, found that the statement, “the local was placed under Trusteeship related to the mishandling of funds by then President Jeane Gardiner” mailed out to approximately 2,200 union members on July 11, 2017, by APWU Local 0185 President Al Davison, was defamatory. The verdict was unanimous that the statement was defamatory. The jury found that the statement was false at the time the statement was made.
The twelve person jury found that Al Davison and APWU 0185 in the exercise of ordinary care would have known the statement was false, in that the statement was neither true nor substantially true, and had the potential to be defamatory.
The jury verdict found damage to former President Jeane Gardiner’s reputation totaled $439,956.00. The jury also returned a verdict of $65,800 for mental anguish caused by the defamatory statement. Damages obtained in the verdict by former APWU Local 0185 President Jean Gardiner totaled $505,756. The lawsuit was filed June 22, 2017 and was heard in the 129th Judicial District Court where Judge Michael Gomez presides.
