Did Management violate the CBA when they refused to accept a manual written bid (instead of an electronic bid) from Terry Wells on or about May 18, 2023?

Arbitrator’s Opinion

I have considered all of the facts and evidence within this case and reviewed the joint files and, based upon that, I find that this grievance is due to be sustained. Management shall implement a new procedure that allows employees to electronically reset their PIN and password to the Liteblue and other bid submission system utilized, said employees shall be given the ability to retrieve their password within a few minutes of time electronically and shall eliminate the practice of exclusively mailing of password and PIN resents via US Mail only, due to the time sensitive nature of an employee’s need to access obtain the aforementioned password/PIN resets.

    I want to express my sincere gratitude to our Clerk Craft Director, Grace Baer, for crafting a truly exceptional case with significant national implications. My Vice President, Danny Carinci, also deserves immense credit for their meticulous work at Step 2, including the crucial Additions and Corrections that effectively dismantled management’s arguments.

    Furthermore, we successfully demonstrated the practical consequences of management’s actions by taking the arbitrator on a site visit to observe the non-functional kiosks that employees were no longer able to use for updating their PIN numbers. This victory was a testament to the collaborative efforts of Grace, Danny, Mike, Kim Rose, and our local union.

    I’m immensely proud of the case we brought forward and the wise decision made by our NBAs, Jim DeMauro, Doris Orr-Richardson, and Sandra Munoz-Hernandez, to submit it to arbitration. Our local has a long history of success in arbitration, and we are particularly honored to have been the only local to win a 2-to-1 arbitration case on our RI-399 Case. Despite widespread skepticism, our local remained unwavering in our belief that we had presented a compelling case and would win. Most National APWU Leaders doubted that a 2-to-1 arbitration case could be won, because nobody had won one before, but we proved everyone wrong. I am proud to say that our local was the first and only local to achieve such a victory.

    It’s important to remember that our local’s victories are never about individuals but rather the collective efforts of our team. I extend my heartfelt thanks to everyone who contributed to this successful outcome.

    Every local should follow this – the main point I made in this arbitration was that it was management’s responsibility to provide the employees equipment and access to the bidding procedure at the work place. I argued that not every person has a smartphone or laptop. Also, that there could be situations where their laptop or smartphone wasn’t working. He really also bought in to my argument that replacing a pin should never take more than a simple text/email/phone call in lieu of having sent by mail. The issue is that we have all taken it upon ourselves to use OUR smartphones and computers when management MUST supply them to us, allow us to print out our choices, and immediately change our password.
